Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of the website at beachparkhawaii.com (the "Site") and any online inquiry you submit to Beach Park Tattoo, LLC ("Beach Park Tattoo," "we," "us," or "our"). By using the Site or submitting a form, you agree to these Terms. If you do not agree, please do not use the Site.

These Terms cover the Site and the inquiry process. The tattoo or piercing service itself is governed by the consent forms, age verification, and aftercare acknowledgment you sign in person at your appointment, plus any applicable Hawaii state regulations. Where the in-studio documents and these Terms address the same topic, the in-studio documents control for the service.

2. Who we are

Beach Park Tattoo, LLC operates the Site and the studio at 602 Kailua Road, Kailua, HI 96734. You can reach us at (808) 782-3180 or info@beachparkhawaii.com.

3. Using the Site

You may use the Site to learn about Beach Park Tattoo, view artist portfolios, read reviews, and submit a tattoo or piercing inquiry. When you use the Site you agree:

  • Not to attempt to access any part of the Site that is not made publicly available
  • Not to scrape, mass-download, or use automated tools to extract content from the Site
  • Not to upload viruses, malware, or any content intended to harm the Site or its users
  • Not to impersonate another person when submitting an inquiry
  • Not to use any portion of the Site for an unauthorized commercial purpose, including reselling, repurposing, or republishing artwork or photographs you find here

We use Cloudflare Turnstile and other tools to detect automated abuse. Requests that look automated may be blocked.

4. Online inquiries

Submitting an inquiry through the Site does not create an appointment, a contract for services, or a guaranteed price. It tells us what you are interested in and starts a conversation. We will reply by phone or email, usually the same day during open hours, to confirm details and either schedule an appointment or let you know if the project is not a fit for our studio.

You agree that the information you submit is accurate to the best of your knowledge. We may reasonably ask follow-up questions before booking.

5. Booking, deposits, and cancellations

Most appointments require a deposit to hold the slot. The deposit amount is set per project at consultation and is applied to the final price of the service. Specific terms are confirmed when we book your appointment.

  • Reschedules: With at least 24 hours notice, we will reschedule and your deposit carries to the new appointment.
  • Same-day cancellations and no-shows: The deposit is forfeited. The slot can be rebooked but a new deposit will apply.
  • Multiple reschedules: Repeated reschedules at the artist's discretion may require a fresh deposit before the next booking.

If we cancel an appointment for any reason on our side, your deposit is refunded or applied to a new booking, your choice.

6. The tattoo or piercing service itself

Tattoos and piercings are permanent body modifications performed by licensed artists in our studio. At your appointment you will sign a consent form, confirm your age, present a valid government photo ID, and acknowledge the aftercare instructions before any work begins. These in-studio documents are the controlling agreement for the service.

Final healing and appearance depend on factors outside our control, including your skin, your overall health, and how closely you follow aftercare. We do not guarantee any specific healing outcome. If something looks off in the first 60 days, contact your artist; minor touch-ups for the original artist's work are typically free at the artist's discretion within that window.

7. Minors

Beach Park Tattoo follows Hawaii law on age requirements. Tattoos are not performed on anyone under the age of 18 except where allowed by Hawaii law with parent or guardian present and consenting in person. Piercings on anyone under 18 require a parent or guardian present at the appointment with valid identification for both the parent or guardian and the minor.

The kids ear piercing service is offered with that requirement made explicit at booking and at the appointment. If the parent or guardian is not present with ID at the appointment, the piercing cannot proceed and the deposit policy in Section 5 applies.

8. Photography, portfolio use, and intellectual property

Custom artwork created by our artists is the artist's original creative work. The artist retains the copyright and the moral rights in the artwork. As a client, you receive the tattoo or piercing as a service and the right to enjoy the resulting work on your body, which is yours.

Our artists frequently photograph completed work and may use those photographs in our portfolio, on our social media accounts, on the Site, and in our marketing. By default, we treat your appointment as including consent for portfolio use. You can opt out at the appointment, in writing or verbally, and we will mark your record accordingly. If you opt out and we have already used a photograph, contact us at info@beachparkhawaii.com and we will remove it within a reasonable time.

The Site itself, including its design, written content, photographs, code, and the Beach Park Tattoo name and logo, is the property of Beach Park Tattoo, LLC or its artists. You may view, share links to, and reference the Site for personal and non-commercial purposes. You may not copy, reproduce, or republish content for commercial purposes without written permission.

9. SMS messages

If you provide your phone number on an inquiry form and opt in to SMS, you may receive automated text messages from Beach Park Tattoo about your inquiry, your appointment, or aftercare. Frequency varies based on your appointment activity. Message and data rates may apply through your carrier. Reply STOP at any time to opt out, or HELP for assistance. Opting out does not affect your ability to keep your appointment; we will follow up by email or phone.

10. Disclaimers

The Site is provided "as is" and "as available." We make reasonable efforts to keep it running and accurate, but we do not warrant that the Site will be uninterrupted, error-free, or completely up to date. Information on the Site, including artist availability, hours, pricing references, and any examples of past work, is for general guidance and may change without notice.

To the fullest extent permitted by Hawaii law, we disclaim all warranties, express or implied, including any warranties of merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow the exclusion of certain warranties, in which case those exclusions do not apply to you.

11. Limitation of liability

To the fullest extent permitted by Hawaii law, our total liability to you for any claim arising out of or related to the Site or an online inquiry is limited to the amount you paid to Beach Park Tattoo for the service in question, or one hundred dollars (US$100) if you have not paid us anything. We are not liable for indirect, consequential, incidental, special, or punitive damages. Some jurisdictions do not allow these limitations, in which case the limitation is reduced to the smallest amount permitted by applicable law.

Nothing in these Terms limits any rights you have under applicable law that cannot be waived by agreement, including consumer protections under Hawaii law.

12. Indemnification

You agree to defend, indemnify, and hold harmless Beach Park Tattoo, LLC and its owners, artists, and staff from any third-party claim arising out of your misuse of the Site, your breach of these Terms, or content you submit through an inquiry that infringes or violates someone else's rights. We will give you prompt notice of any such claim and reasonable cooperation in defending it.

13. Suspension or termination of Site access

We can suspend or block access to the Site, or refuse to process an inquiry, if we reasonably believe a user is violating these Terms, attempting to abuse the inquiry system, or engaging in conduct that puts the Site or other users at risk. You can stop using the Site at any time. Sections 8 (intellectual property), 10 (disclaimers), 11 (limitation of liability), 12 (indemnification), and 14 (governing law) survive any termination.

14. Governing law and venue

These Terms are governed by the laws of the State of Hawaii, without regard to its conflict-of-laws rules. Any dispute arising out of or related to these Terms or the Site that cannot be resolved through good-faith discussion goes to the state or federal courts located in Honolulu County, Hawaii. You and Beach Park Tattoo each consent to the personal jurisdiction of those courts. The parties may, by mutual written agreement, elect to resolve a dispute through arbitration administered by a recognized arbitration provider.

15. Changes to these Terms

We may update these Terms when our practices change or when required by law. Material changes will be reflected in the "Last updated" date at the top and called out where reasonable on the Site. Continued use of the Site after a change takes effect means you accept the updated Terms. If you do not agree, stop using the Site.

16. General

If any provision of these Terms is held unenforceable, the rest of the Terms remain in effect. Our failure to enforce any provision does not waive our right to enforce it later. These Terms, along with the Privacy Policy and the consent forms you sign in studio, are the complete agreement between you and Beach Park Tattoo about the Site and the services described here. You cannot transfer these Terms to anyone else; we can transfer them in connection with a sale or reorganization of our business.
